General Terms and Conditions

1. Scope

These General Terms and Conditions ("Terms") apply to all contracts concluded between Carship.li , Industriering 20, 9491 Rugell, Liechtenstein (hereinafter "carship.li" or "we") and customers (hereinafter "customer" or "you") relating to the use of the services offered on the carship.li platform.

Deviating terms of the customer will not be recognised unless carship.li has expressly agreed to them in writing.

2. Subject Matter of the Contract

carship.li operates an online platform for brokering vehicle transport, registration services, customs clearance and other related services. The subject matter of the contract results from the specific order placed and these Terms.

carship.li is entitled to have the services provided by its own staff or by qualified third parties (subcontractors, partners).

3. Quote and Conclusion of Contract

The services presented on carship.li do not constitute a binding offer but an invitation to submit an offer (invitatio ad offerendum).

By submitting a request or an order via the platform, the customer makes a binding offer. The contract is concluded when carship.li accepts this offer in writing or text form, or begins performing the service.

4. Prices and Payment Terms

All prices are stated in Swiss francs (CHF) or euros (EUR) and are exclusive of the applicable statutory value-added tax, unless expressly agreed otherwise.

Payment is generally to be made by credit card or SEPA instant transfer prior to the provision of the transport service. The total amount is held in trust, and service providers are only compensated by Carship.li once the orders have been fulfilled.

5. Performance and Acceptance

carship.li will provide the agreed services on time, professionally and in accordance with recognised industry standards. Delivery times are provided to the best of our knowledge but are non-binding unless expressly agreed otherwise in writing.

The customer is obliged to inspect the services provided without delay and to report any defects in writing or in text form within 7 days of performance.

6. Liability

Carship.li is not liable for damages or delays caused by third parties (e.g. transport companies, registration authorities), as the platform only serves to broker transport, customs and registration services.

7. Data Protection

The protection of your personal data is important to us. Personal data is processed in accordance with our Privacy Policy and applicable data protection law, in particular the GDPR.

8. Right of Withdrawal for Consumers

If you are a consumer within the meaning of § 13 BGB and the contract was concluded electronically, you are entitled to a right of withdrawal under the conditions of the Distance Selling Act. Detailed information can be found in the separate withdrawal instructions.

9. Dispute Resolution and Jurisdiction

To the extent legally permitted, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Rugell, Liechtenstein. The law of the Principality of Liechtenstein applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.

10. Severability Clause

Should individual provisions of these Terms be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.

11. Changes to These Terms

carship.li reserves the right to amend these Terms at any time with effect for the future. Amended Terms will be communicated to the customer in good time. Continued use of the platform shall be deemed acceptance of the amended terms.
